You've taken on the important responsibilities of serving as a guardian for another individual we're going to spend some time discussing part of that responsibility called the Annual Report of Guardian. Hi, I'm Darren Findling of The Probate Pro and we assist people in administering and managing guardianship in Michigan let's understand the context upon which this responsibility falls as the Guardian you are responsible for many obligations on behalf of the person you're serving as the Guardian for which the court refers to as the ward you are responsible for taking care of all of these requirements as set forth under Michigan law and the Michigan Court rules so this timeline here describes the general timeline from the beginning of the petition to establish a guardianship through the letters of guardianship being obtained and then the on the one-year anniversary this is the period of time what we call the end or reporting requirement you have 56 days so a little short of two months from the anniversary date of your appointment to file this in a report of Guardian MCL 700 points I identifies that the guardian must do this reporting and identify whether there's any reason that exists for the continuation or termination for that guardianship in addition there's a Court Rule MSMC are 5.40 9 it provides that the guardian shall do so within 56 days of that anniversary date of appointment and then serve it upon the interested parties as set forth in another Court Rule MCR 5.12 5c 24 now I know your mind may get mixed up with all these statutes and Court rules and that's why it's important to work with an attorney that can guide you through this difficult and often complicated process let's talk a little bit about the service of that in a report of Guardian this that Court Rule provides the person's interested in receiving that and report of Guardian whether it's for a minor or for an Adele include the individual as long as they're over 40 years of age the person or entity that has custody of that individual so for example the individuals in a group home or in a facility or living with somebody the spouse and adult children are also entitled to notice and when there's a minor guardianship the parents and if neither of them are living then the grandparents are presumptive heirs so again it's important to give appropriate notice to ensure that you're fulfilling your responsibilities now when you do file this annual report of Guardian a condition of legally incapacitated person what that does is that allows you to remain as guardian for an upcoming year for another year it's like repeat and rinse the idea is each time you do this it allows you to go back to the court to get an updated letter of guardianship now in the happenstance that the person has died or you indicate that the person has improved such that they no longer need a guardian you would reflect that on the inner report as well as file the requisite documents to inform the court of either the death or the need to terminate the guardianship let's go in the form let's go into the form and kind of analyze how you complete this so this is the form you use to complete the and/or report of Guardian it is a form that can be found at the probate court you could find it online and you're welcome to contact my office we'll provide it to you free of charge it is the form PC 635 is a state-approved form that the court will readily accept for filing on this form at the top left corner you're going to identify the county upon which the probate court has jurisdiction over the guardianship and in the top right corner you're going to identify the case number generally the case numbers for adult Guardian ships will have the letters
